Jim Parton heads the employment practices group at Parton & Sell in Larkspur CA. He represents management in the defense of workplace harassment, discrimination, and wage and hour litigation in California. Jim has been honored as a Northern California “Super Lawyer” from 2004 to the present. He is a member of the California, the Northern and Eastern Districts of California and the U.S. Supreme Court bars. Jim was the program chair of the 2008 Employment Law Committee seminar.
Jim has over 35 years of experience in trial and appellate litigation, specializing in employment law, products liability, real property law and consumer rights litigation. As an employment law attorney, he has successfully defended businesses of all sizes, as well as individual managers, against all kinds of employment claims. His experience includes defending management in federal and state court lawsuits involving claims of race, sex, age, sexual-orientation, national origin and disability discrimination; sexual, harassment; wrongful termination; retaliation; workplace violence; invasion of privacy; wage & hour violations; unfair business practices; and trade secrets violations. He has defended individual claims, multiple plaintiff sexual harassment claims and wage and hour class actions involving classification, meal and rest periods and other pay-related issues.
Jim’s experience also includes representing his clients in a variety of administrative proceedings, including Labor Code §132a retaliation claims before the Workers Compensation Appeal Board, proceedings before the California Labor Commissioner, and investigations by, and administrative proceedings before, the Department of Fair Employment and Housing, the Equal Employment Opportunity Commission, the Department of Labor Standards Enforcement and the Department of Labor. Additionally, Jim’s skill, experience and credibility developed through hundreds of mediations helps his clients resolve difficult cases for a fraction of their risk.
As general counsel to numerous businesses, Jim helps his clients avoid expensive lawsuits and administrative claims. His experience includes: preparation of employment contracts and severance agreements; supervising and directing investigation of claims regarding sexual, racial, disability and other harassment and discrimination; advising management regarding compliance with federal, state and local affirmative action requirements; directing the interactive process response to claims of disability and requests for reasonable accommodation; and guiding management through tricky employee discipline and termination issues.
In addition to his broad experience as an employment law attorney, Jim has devoted his career to the defense of product liability and catastrophic personal injury and wrongful death litigation. He has applied this deep legal experience defending Honda in complex motor vehicle product liability and warranty litigation for over 30 years. He has represented a wide range of manufacturers involving vehicular, recreational, consumer and home products.
Jim also defends clients in many other types of civil litigation including:
-Real Property Law (disability access rights (ADA Title III); landlord-tenant; housing discrimination; quiet title & adverse possession; lot line & other neighbor disputes; and premises liability)
-Consumer Rights (consumer warranty; Fair Credit Reporting Act; privacy rights; unfair business practices; Consumer Legal Remedies Act)
