Tom Hurney has over thirty six years of experience litigating and trying cases involving serious personal injury, wrongful death and commercial disputes. He has substantial experience defending medical liability and other health care related actions. He has represented clients in class actions involving chemical releases, contaminated steroids, pension disputes and medical record charges.

Tom has appeared before the Supreme Court of Appeals of West Virginia over twenty five times. Significant cases include the successful appellate defense of the constitutionality of West Virginia's non economic caps, a case absolving hospitals of liability for non-employed physicians. He has filed amicus briefs ranging from rights of mineral owners, to health care, products liability and industrial injury cases.

Tom is a Fellow of the American College of Trial Lawyers (ACTL), an Associate member of the American Board of Trial Advocates and a Fellow of the Litigation Counsel of America. Active in DRI and other defense groups, he is a past president of the Defense Trial Counsel of West Virginia which gave him its first "Defense Lawyer of the Year" award in 2014. Tom served as President of the Association of Defense Trial Attorneys (ADTA) in 2017-18 and was on DRI's Board of Directors from 2016-19. He is a member of IADC and taught in its 2014 Trial Academy (The Penhooligans) and is also a member of the FDCC. He is a frequent speaker on a variety of legal topics, with presentations at DRI and other meetings.

Tom has an AV preeminent rating by Martindale-Hubbell and has been recognized in various peer publications, including Best Lawyers in America®, BTI, Chambers USA, Law & Politics' West Virginia Super Lawyers® (which recognized him as the Top Lawyer in West Virginia in 2019), and Benchmark, where he is recognized as a local Litigation Star.

Tom received both his law (cum laude, 1983) and undergraduate (Business Administration, 1980) from the University of Dayton, and remains a loyal Flyers fan.
Tom is married with three children. His wife and two daughters are lawyers and his son started law school in the fall of 2019.
