Neva G. Lusk is a Member of the firm Spilman Thomas & Battle, PLLC. Ms. Lusk practices general litigation with emphasis on product liability, medical device and pharmaceuticals, toxic torts and class actions. She has handled numerous trials in circuit courts and United States District Courts. She serves as trial counsel for corporate clients in mass toxic exposure matters, including class actions. In addition, she serves as lead counsel for corporate clients in consolidated product liability matters and has vast experience with defense of medical device manufacturers. Ms. Lusk serves as liaison counsel for manufacturers in mass tort litigation in federal and state courts and is well versed in the defense of hospitals, individuals and corporations in health care litigation, both civil and criminal. Her health care experience also includes hospital privileges litigation and Medicare and Medicaid fraud and abuse.
Ms. Lusk is a member of the DRI Board of Directors, the DRI Public Policy Committee, the DRI State Reps Task Force, the Minority Scholarship committee, Board liaison to the Drug & Medical Device substantive law committee and former Board liaison to the Electronic Discovery substantive law committee, the steering committee for the DRI Women in the Law Committee and served as chair of the subcommittee relating to research on women's issues. She is also a member of the International Association of Defense Counsel (IADC) and serves as Vice Chair of Newsletters for the IADC Alternative Dispute Resolution committee. She is a member of the IADC 2011 Trial Academy faculty. Ms. Lusk is a Master of the Bench for the American Inns of Court, Judge John A. Field, Jr. Chapter. She is also a member of the Lawyers for Civil Justice and the American Bar Association.
She is AV® Preeminent™ Peer Review Rated by Martindale-Hubbell and is listed in The Best Lawyers in America, Commercial Litigation and White Collar Criminal Defense, and is recognized as a Leading Litigation Attorney in Chambers USA America's Leading Business Lawyers. She is also recognized as a West Virginia Super Lawyer.
She is the Past President of The Defense Trial Counsel of West Virginia and served as the DRI State Representative for West Virginia. She is a former member of the West Virginia State Bar Board of Governors and the Board of Directors of the West Virginia Bar Foundation. Ms. Lusk serves on the Board of Directors and for many years was Vice President of Allocation for the Fund for the Arts, the Kanawha Valley’s United Arts Fund.
Ms. Lusk received her B.A. from Marshall University and her J.D. from West Virginia University. She is admitted to the West Virginia State Bar, West Virginia Supreme Court of Appeals, the United States District Courts for the Northern and Southern Districts of West Virginia and the United States Courts of Appeals for the Third and Fourth Circuits.
Prior to joining the firm, she was the Assistant Prosecuting Attorney for Kanawha County, West Virginia.
