Defense Wins
Member Bio
Beth S. Rose is nationally known for her defense of pharmaceutical and medical device companies in complex product liability and mass tort litigation. She is the lawyer to whom General Counsel turn when they need an aggressive but practical approach to “bet the company” product liability matters. Clients rely on her expertise to develop successful and cost-effective strategies consistent with their business goals. Through her efforts, clients have obtained dismissals and prevailed at trial.
Ms. Rose developed her expertise in product liability matters in the late 1980s when she successfully defended a medical device manufacturer in a number of AIDS needle stick and AIDS phobia claims. She has served as national counsel to several pharmaceutical and medical device companies defending mass tort litigation including claims relating to PPA, latex gloves and a generic form of Accutane. She also led the defense of a contract research organization defending claims against a new class of antibiotics. She has successfully defended matters involving a variety of medical devices, consumer products, pharmaceuticals, foods, chemicals and industrial machines, as well as asbestos, mask respirator, silica and benzene claims.
Ms. Rose also has experience handling personal injury, consumer fraud and medical monitoring class actions. She successfully represented a pharmaceutical company in a putative nationwide class action involving an anti-arrhythmic cardiac drug. She served as co-chair of the Mass Tort Subcommittee of the ABA Litigation Section’s Class Action Committee.
Ms. Rose is Co-Chair of the Sills Cummis & Gross Litigation Practice Group and Chair of the Firm's Product Liability Practice Group. She was also elected to the Firm’s Management Committee.

Firm Information
Sills Cummis & Gross, a full-service corporate law firm, with offices in New Jersey and New York, has the capabilities of a New York full-service law firm, but offers the economic benefits of a New Jersey-based headquarters. Our client roster ranges from Fortune 500 to emerging growth and foreign corporations doing business in the U.S.
Sills Cummis & Gross has earned a reputation as a “go-to” firm to defend complex product liability cases and mass tort litigation. For the past four decades, we have successfully represented pharmaceutical, medical device, consumer product, industrial equipment and chemical companies as national, regional and New Jersey counsel in “bet the company” litigation.
Our product liability and mass tort lawyers are known for their legal, scientific, technical, trial and settlement expertise. Our understanding and experience with e-discovery enables us to successfully tackle the most vexing of discovery issues, including cases where a “live” product is the subject of litigation. Our lawyers have prevailed at every stage of litigation including motions to dismiss the pleadings, summary judgment, trial and on appeal. We have tried product liability cases to juries across the United States and are often sought out as New Jersey trial counsel for complex cases designated as mass torts by our Supreme Court.
We take pride in partnering with our clients to understand their business needs. Toward that end and in addition to defending product liability litigation, we help our clients conserve their resources by resolving claims before they evolve into litigation through mediation or other early case assessment strategies. We also counsel and help clients develop practical and effective risk management strategies. When the need arises, we handle complex commercial cases relating to the industries our clients serve.
Our practice group has been ranked by Chambers USA as a “leading firm” in product liability, and our lawyers have been recognized by Martindale-Hubbell, Law360, The Best Lawyers in America and New Jersey Super Lawyers. We regularly write about important issues in product liability litigation in a variety of publications, and lecture at product liability seminars throughout the United States.
