Defense Wins
Member Bio
As a trial lawyer for nearly 25 years, it has been my privilege to represent, advise, and defend management in employment law issues. From Fortune 100 companies to start-ups, I regularly work with clients in the health care, pharmaceutical, education, financial, telecommunications, information technology, and transportation sectors. I counsel management on current employment law issues, guide them through legal challenges, and defend their interests in federal and state courts across the country. I have a particular expertise protecting corporate trade secrets through drafting, interpretation, and enforcement of post-employment restrictive covenants.
My expertise includes:
• Defending management against claims of discrimination, retaliation, and harassment
• Drafting non-compete, confidentiality, non-solicitation, and no-hire agreements
• Litigating actions to protect corporate trade secrets and confidential information
• Minimizing risk when recruiting high-value executives from competitors
• Protecting companies from “whistleblower” and hostile work environment claims
Firm Information
I handle employment litigation and advise clients throughout the country on all aspects of employment law, including discharge, discipline and other personnel problems, internal investigations, and leave of absence issues.
My practice concentrates on complex employment litigation at the state and federal levels, encompassing wrongful termination, employment discrimination arising under Title VII and similar state statutes, sexual harassment, hostile work environment, constructive discharge and retaliation claims, and whistleblower actions.
I extensively litigate and counsel clients on the meaning, drafting, and enforceability of various types of post-employment restraints such as non-compete agreements, non-solicitation provisions, confidentiality agreements, and other restrictive covenants. I have successfully tried these types of cases to conclusion in state and federal courts. I am recognized by New Jersey Super Lawyers and named a New York Area Top Rated Lawyer by ALM Media.
A frequent lecturer, I have presented at the New Jersey Institute of Continuing Legal Education, the New Jersey Defense Association, the Council on Education in Management, the Employers Association of New Jersey, and other organizations. I have published more than three dozen articles on employment law and litigation, am a contributing author of Vol. 18, New Jersey Practice – Employment Law, 2d Ed. (Goldstein, et al., eds., West Group, 2005), and am quoted often in the media.
I appeared several times before the Supreme Court of New Jersey on behalf of the Employers Association of New Jersey as amicus curiae, have successfully argued matters on appeal, have litigated matters to conclusion in state and federal court and before the U.S. Equal Opportunity Commission and state civil rights enforcement agencies, and have nearly three dozen reported decisions in employment law to my credit.
