Eric Hurwitz handles a wide range of legal disputes. He has extensive experience defending claims against banks, mortgage lenders and servicers, auto finance companies, debt collection companies and other financial services companies. These claims may involve both federal and state laws, such as the Truth-in-Lending Act and Regulation Z, the Home Ownership and Equity Protection Act, the Real Estate Settlement Procedures Act, the Fair Credit Reporting Act, the Fair Debt Collection Practices Act, the Telephone Consumer Protection Act, and state unfair trade practices and consumer protection laws.
Mr. Hurwitz also represents clients in resolving title insurance disputes, contested lien priorities, class actions involving financial products and services, and bankruptcy-related claims including alleged stay and discharge violations. He also defends banks from claims involving converted, forged and altered checks under the Uniform Commercial Code, as well as claims under the Electronic Funds Transfer Act.
In addition, Mr. Hurwitz has experience handling legal disputes for clients in other matters, including health care, mass tort, products liability, medical malpractice, construction, fidelity and surety, insurance and general commercial litigation. He has a full range of experience in federal and state trial and appellate courts, as well as mediations and arbitrations, both regionally and throughout the country.
Some of his notable representations include:
-representing consumer and commercial lenders in a variety of claims, including litigation arising out of troubled loans; fraud; credit reporting; debt collection practices; and claims involving the origination, servicing, reporting and collection of loans, including contested foreclosure matters and loan workouts and modifications
-representing multinational pharmaceutical companies in litigation and regulatory matters, including products liability defense and counseling for compliance with statutory and regulatory requirements
-defending sureties in litigation arising from payment and performance bond claims stemming from Pennsylvania, Delaware and New Jersey construction projects
-representing both owners and contractors in a range of construction disputes involving construction defect, breach of contract and mechanics’ lien claims
-handling litigation for a large commercial landscaping company, including employment, toxic chemical exposure and premises liability claims
-representing property-casualty insurers in commercial and personal lines coverage disputes, including homeowners, motor vehicle and flood-related coverage litigation
Mr. Hurwitz has written on the topic of litigation risk in the wake of the Dodd-Frank Wall Street Reform and Consumer Protection Act. He has also written on performance and payment bond claims under Pennsylvania law, as well as various exclusions under the commercial crime insurance policy.
In 2011 Mr. Hurwitz was named to the New Jersey Law Journal’s “40 under 40” list, which is comprised of the top 40 young professionals in the New Jersey legal community.
