Kelly Kosek is a Litigation Partner at Hahn Loeser Parks LLP.

Ms. Kosek is admitted to practice law in Ohio and before the Sixth Circuit Court of Appeals, Eighth Circuit Court of Appeals, the Northern District of Ohio, and the Southern District of Ohio.

Ms. Kosek has defended clients in a broad range of litigation matters. Her experience includes cases involving putative class actions, contract disputes, and a variety of torts including manufacturing and design defects, civil conspiracies, and premises liability claims. She has represented clients across a broad spectrum of industries including the title insurance industry, mortgage industry, car rental industry, and home-warranty industry. She has also represented manufacturers of automobiles, chemicals, refractory products, and firearms.

Kelly has significant experience in defending class actions. Kelly was a member of the trial team that successfully defended Chicago Title Insurance Company against plaintiffs’ allegations of punitive damages. In Krause v. Chicago Title Insurance Co., the Jackson County, Missouri jury awarded plaintiffs no punitive damages, although plaintiffs’ counsel requested over $200 million in punitive damages. Kelly also defeated class certification in Hartis v. Chicago Title Insurance Co., 2009 U.S. App. LEXIS 5372 (8th Cir. Mar. 13, 2009) and Doll v. Chicago Title Insurance Co., 246 F.R.D. 683 (D. Kan. 2007). Kelly has also defeated putative classes via summary judgment. See Salling v. Budget Rent-A-Car Systems, Inc., 2010 U.S. Dist. LEXIS 70603 (N.D. Ohio July 14, 2010); Arevalo v. Fidelity National Financial, Inc., 2009 U.S. Dist. LEXIS 21607 (W.D. Tex. Jan. 29, 2009), aff'd Murray v. Fidelity National Financial, Inc., 594 F.3d 419 (5th Cir. 2010). Other class actions have been defeated through motions to dismiss—both before and after class certification. See Trohoske v. Chicago Title Ins. Co., 2011 U.S. Dist. LEXIS 137704 (N.D. Ohio Nov. 30, 2011); Eberhard v. Chicago Title Ins. Co., 11CV934 (N.D. Ohio Mar. 31, 2012); Kaplan v. Fidelity National Home Warranty Co., 37-2008-0087962 (San Diego Superior Court July 26, 2012).
