Melissa Lin has earned the AV® Preeminent TM* Peer Review Rating and has been practicing since 2005. She is licensed in Arizona and California. Her practice includes the representation of individuals, contractors, businesses, and governmental entities in tort and contract litigation, primarily in the areas of construction defects, general liability, personal injury, premises liability, and product liability. Ms. Lin was honored as a 2012 through 2015 Southwest Super Lawyers Rising Star. She was also selected as one of the top Phoenix attorneys in the October/November 2013 issue of North Valley Magazine. She is the 2015 DRI Diversity Seminar Vice Chair and Expo Chair, the 2014 DRI Diversity Expo Co-Chair, the 2015 DRI Construction Law membership Chair, and the Local Marketing Chair for the 2014 DRI Women in the Law Seminar. She has been a board member of the Arizona Asian American Bar Association, the Maricopa County Bar Association (MCBA) Litigation Section, the MCBA Construction Law Section, and the Arizona State Bar Young Lawyer’s Division.
Ms. Lin has successfully defended, mediated, and settled numerous construction defect cases for general contractors and developers involving multiple homeowners and homeowners’ associations. She successfully prevailed on a defense motion for summary judgment on a breach of implied warranty claim through appeal, motion for reconsideration, and motion for new trial where Plaintiff alleged damages over a million dollars. The ruling on motion for partial summary judgment limited Plaintiff’s damages to approximately $50,000, and led parties to ultimately settle.
She was second chair for the defense of a multi-week seven day construction defect trial where Plaintiff was requesting just under a million dollars in damages, and the defense asserted a cost of repair of just under $200,000. The jury found for the defense on common law fraud, consumer fraud, and negligent misrepresentation claims, and only awarded Plaintiff damages on warranty claims in the amount of $230,000. As a result of defense work on fee-shifting, Plaintiff agreed to walk away from the trial judgment with each party bearing their own fees and costs.
Ms. Lin is extremely active and dedicated to the local and legal communities. She was elected, re-elected, and served as a 2008-2011 Arizona State Bar Young Lawyers Division (YLD) District 4 Representative, the 2011-2012 YLD Secretary, and the 2012-2013 YLD Treasurer. She has been involved with the YLD Maricopa Holiday Party Committee for foster children since 2008, and was the 2009 and 2010 Chair. She served as the 2011-2012 chair, 2009-2010 vice-chair and 2008-2011 board member of the MCBA Construction Law Section. She was a 2011-2013 board member of the Arizona Asian American Bar Association (AAABA). She was the 2010-2011 president, 2009-2010 vice president of membership, and 2008-2009 secretary and board member of the Women's Metropolitan Arts Council (WoMAC) of the Phoenix Art Museum. She has been involved with the Arizona Association of Defense Counsel (AADC) since 2007 and was the 2009-2011 vice president and board member of AADC YLD. She is a member of the Defense Research Institute (DRI) and was involved with the planning and marketing committee for the 2010 and 2012 DRI Women's Sharing Success Seminar. She is a member of the Arizona Women's Law Association (AWLA). She was also a 2009-2012 member of the Thurgood Marshall Inn of Court.
She was the December 2011 Phoenix Art Museum Volunteer of the month. She received the 2006 Pro Bono Service Award from Community Legal Services in Mohave County.

•Resolve: We bring about closure quickly and efficiently. Complex litigation is renowned for being protracted and expensive. We recognize this is rarely in the best interest of our clients. We do everything possible to position our clients for success at trial while striving toward an early and favorable resolution.
