francesca sabbatino is an av rated litigator and trial attorney with over 25 years of experience in all phases of litigation from initial claim assessment through trial and appeal. ms. sabbatino has devoted her practice to the defense of high exposure claims arising out of construction, premises, bus, auto and railway accidents together with security, police, 42 u.s.c. 1983 actions and medical malpractice, product liability and toxic tort claims.

ms. sabbatino began her career with the new york city law department as an assistant corporation counsel. she was assigned to the special litigation/medical malpractice unit and defended the city of new york against the highest exposure and profile cases. she was responsible for defending hundreds of multi-million dollar medical malpractice cases arising out of treatment rendered at 11 member new york city health and hospital (“nychhc”) facilities. ms. sabbatino also served as a liaison between the law department, nychhc risk management, the office of the comptroller and several outside law firms. following her tenure in this unit ms. sabbatino went on to become a senior member of the law department’s manhattan trial unit where she tried numerous cases to verdict.

after leaving the law department, ms. sabbatino joined the private sector and in 1995 she became a partner in the firm of armienti & brooks, p.c. during her 10 years at armienti & brooks, ms. sabbatino specialized in defending owners and contractors against actions arising out of construction site accidents. in addition she continued to represent municipal entities, including the new york city housing authority in negligent security claims and the new york city transit authority in catastrophic subway and bus accidents. she went on to head the firm’s toxic tort practice group, specializing in defending lead paint claims.

in 1999 ms. sabbatino moved her practice and became of counsel to russo, keane & toner where she continued to represent several major insurers, property owners, corporations and municipal entities in products liability, general liability, including premises, auto, construction and toxic torts. in april 2011 ms. sabbatino formed rush & sabbatino, pllc.

ms. sabbatino’s legal scholarship has resulted in several notable published decisions including mccarthy v. sturm ruger, 916 f. supp 366, in which she obtained dismissal of all claims against the manufacturer of ammunition used in a mass shooting on the long island rail road. the dismissal by the federal court in mccarthy formed the basis for dismissal of three related state court claims brought by the families of other shooting victims.

in bondi v. bambrick, 764 n.y.s. 2d 674, ms. sabbatino successfully authored and argued an appeal which resulted in the downward modification of a jury award against an intoxicated truck driver who struck and severed the leg of a 24 year old motorcycle passenger. the defendant was tried and convicted of felony charges arising out of the accident. ms. sabbatino successfully obtained a $7,000,000 reduction in punitive and compensatory damages.

ms. sabbatino has been called upon to lecture to the bar on a number of topics, including, municipal liability, liability of adjoining landowners for sidewalk defects and lead paint liability. along with her partner, claire rush she was a lecturer on current issues in construction law, south bronx economic development corporation, turner construction school, 2011.

ms. sabbatino received her b.a. from fordham university in 1981 where she double majored in history and political science. at fordham university she was the first woman student body president. ms. sabbatino received her jd in 1984 new york law school. there she was a member of the moot court executive board and finalist in the national moot court competition.

ms. sabbatino is admitted to practice law in the state of new york, the united states district court for the southern and eastern district and the united states supreme court. she is a member of the council on litigation management, the defense research institute, the defense association of new york, the association of professional women in insurance, the new york city chapter of the international association of insurance professionals and the new york city women’s bar association where she is co-chair of the litigation committee.
