Member Bio

Zohaib Maladwala is an attorney in Fasken Martineau's Litigation and Dispute Resolution Group. He has a broad civil litigation practice with a particular focus on class actions, product liability litigation and complex commercial disputes. He has represented clients in a wide variety of industries including the automotive sector, mining, professional/financial services and medical device manufacturers. He has assisted with matters before all levels of Court, including the Supreme Court of Canada, and has appeared before all levels of Court in Ontario.

Zohaib has extensive class actions experience, in particular relating to price-fixing/antitrust matters, securities misrepresentation cases and allegations of manufacturing defect. In addition to his class action and product liability experience, Zohaib also has experience representing both dealerships/franchisees and franchisors in complex franchise disputes, and has been involved in a number of cases arising following the departure of senior officers/employees and involving allegations of breach of contract, breach of fiduciary duty and breach of confidence.

Zohaib is a member of Fasken Martineau's Student Development Committee, which is responsible for the recruitment and development of Fasken Martineau’s summer and articling students, and is involved in the organization and implementation of the Litigation Department’s Continuing Legal Education Program. As part of the Pro Bono Law Ontario Duty Counsel Project, Zohaib also acts as duty counsel to unrepresented litigants at the Ontario Small Claims Court, where he provides summary advice and represents clients in settlement conferences, motions and trials. Zohaib is also in the process of completing a certified legal project management course which will assist him in providing clients with practical advice in the most efficient manner.

Zohaib summered and articled with the firm, during which time he was seconded to the United Nations Commission for International Trade Law in Vienna, Austria.
