All About Bankruptcy: A Primer for Non-Bankruptcy Lawyers
Non-bankruptcy litigators will learn the basics of bankruptcy law. Panelists will provide helpful tips and strategies for dealing with bankruptcy-related issues that arise in a general litigation practice. This webinar will provide an overview of the Bankruptcy Code and the types of bankruptcies that are available. Panelists will discuss the types of information found in bankruptcy pleadings and how that information might be useful in non-bankruptcy litigation. Attendees will learn about typical issues that arise in a bankruptcy case including sworn statements, automatic stays, voidable preferences, adversary proceedings, and the bases of dischargeability.

What will you learn?

  • Judicial estoppel and how it might be used in connection with non-bankruptcy litigation;
  • Sworn statements and how those sworn statements might be useful in non-bankruptcy litigation;
  • The automatic stay of Section 362(a) of the Bankruptcy Code, exceptions to it and how to make it go away;
  • What is a "preference" and the basics of defending a preference claim asserted pursuant to Section 547 of the Bankruptcy Code;
  • Unique aspects of a summons issued in connection with a complaint filed in the Bankruptcy court;
  • The basics of discharge and dischargeability under sections 523 and 727 of the Bankruptcy Code.

  • Litigators who deal with bankruptcy-related issues but who do not specialize in bankruptcy
  • Young lawyers who are interested in broadening their knowledge of bankruptcy law
  • Appellate lawyers who are interested in pursuing appellate work in the bankruptcy realm
  • Attorneys handling ADR as mediators and arbitrators who need to understand bankruptcy law and practice
