Testing the Waters: Use of Mock Trials

Testing the Waters: Use of Mock Trials
Mock trying a case is a powerful tool that can show you how a jury may respond to your themes, arguments, and witnesses at trial. With courts anticipating a backlog of trials due to COVID-19, there will be an added push to resolve cases and virtual mock trials can be used to assist in settlement efforts.  Hear from a panel of seasoned attorneys/industry professionals about deciding which cases to mock try, effective ways to prepare for and present evidence and witnesses to a mock jury (both in person and virtually), and how you can use the information gleaned from your mock trial to either settle or prepare your case for trial.

What will you learn?

  • The type of cases that could benefit from a mock trial and how to present a mock trial virtually and in person;
  • What evidence and witnesses to present and the manner in which they are presented;
  • How to ensure that both sides (plaintiff and defense) are adequately represented during a mock trial and effective ways of communicating the opposing side’s case;
  • Tips for selecting a mock panel that is representative of the jury pool where your trial will take place;
  • Considerations as to confidentiality and other concerns arising in mock trials; and
  • What to do with the information gleaned from the mock trial.

Who should attend?

  • Practicing litigators and/or trial lawyers representing clients in connection with catastrophic or high exposure cases; and
  • Industry professionals and clients who are interested in learning the most effective ways for their attorneys to mock trial high exposure cases.
